4. User Content and Responsibility

By using the Service, you acknowledge and agree that:

• You assume all risks and liabilities associated with the content you create
• SmutWriter does not review, edit, approve, or endorse any user-generated content
• You are responsible for ensuring your content complies with all applicable laws
• SmutWriter is not responsible for how you use, publish, distribute, or share your content
• The decision to create adult or explicit content is entirely your own choice

You retain ownership of all content you create using the Service. SmutWriter claims no ownership rights over your creative works.

5. AI-Generated Content Disclaimer

The AI writing assistance provided by SmutWriter is generated by artificial intelligence systems. You acknowledge and understand that:

• AI-generated content may be inaccurate, inappropriate, offensive, or unsuitable for certain purposes
• SmutWriter makes no guarantees regarding the quality, accuracy, creativity, or suitability of AI-generated content
• You must review and take full responsibility for all AI-generated output before using, saving, or sharing it
• AI responses are generated algorithmically and do not represent the views or opinions of SmutWriter
• The AI may produce content that some users find objectionable — this is inherent to an uncensored writing tool

SmutWriter expressly disclaims any liability for AI-generated content and its use by users.

6. Prohibited Uses

While SmutWriter provides an unrestricted creative writing environment, certain uses are strictly prohibited:

• Use the Service to generate spam, malware, or phishing content

7. Subscription and Payment

SmutWriter offers the following subscription options:

• Free Tier: 3 messages per day with basic features
• Premium: Unlimited messages, advanced features, billed at $199.99/year ($16.67/month equivalent)

By subscribing to a paid plan:

• You authorize SmutWriter to charge your payment method for the subscription fee
• Subscriptions automatically renew unless cancelled before the renewal date
• Payment is processed securely through Stripe
• You are responsible for keeping your payment information current
• Prices may change with notice; continued use constitutes acceptance of new pricing

8. No Refunds Policy

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until that time.

By subscribing to SmutWriter, you expressly acknowledge that you have read, understood, and agree to this no-refunds policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

SmutWriter expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Any warranty that the Service will be uninterrupted, error-free, or secure
• Any warranty regarding the quality, accuracy, or reliability of AI-generated content
• Any warranty that the Service will meet your specific requirements or expectations

You use the Service at your own risk and discretion.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMUTWRITER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from content you create, share, publish, or distribute
• Any damages resulting from third-party actions or content
• Any damages arising from your use or inability to use the Service

In no event shall SmutWriter's total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless SmutWriter, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Service
• Content you create, generate, publish, share, or distribute using the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable laws or regulations
• Any claims by third parties related to your content or actions

12. Intellectual Property

Your Content: You retain all ownership rights to the content you create using SmutWriter. We do not claim ownership of your stories or creative works.

Our Service: SmutWriter and its licensors retain all rights, title, and interest in and to the Service, including but not limited to:

• The SmutWriter name, logo, and branding
• The underlying technology, algorithms, and AI systems
• The user interface, design, and functionality
• All software, code, and documentation

You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

13. Termination

By You: You may cancel your subscription and stop using the Service at any time. No refunds will be provided (see Section 8).

By SmutWriter: We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

• You violate these Terms
• You engage in prohibited uses (see Section 6)
• We are required to do so by law
• We discontinue the Service

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data. No refunds will be provided for termination.

14. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

15. Changes to Terms

SmutWriter reserves the right to modify these Terms at any time. We will notify users of material changes by:

• Sending an email notification to registered users (for material changes)
• Displaying a notice within the Service

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through:

1. Informal Resolution: First, by contacting us to attempt to resolve the dispute informally
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in Delaware, in accordance with the rules of the American Arbitration Association

You agree to waive any right to a jury trial or to participate in a class action lawsuit against SmutWriter.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmutWriter regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
